1. About Lostly

Lostly is a service operated by Nordic Business Advisory ApS, trading as Lostly ("Lostly", "we", "us"), a company registered in Denmark. Lostly helps people who have lost items connect with people who have found them. We provide a technology platform for reporting, matching, and facilitating the return of lost and found items.

2. Acceptance of Terms

By creating an account or using Lostly you agree to these Terms of Use. If you do not agree, do not use the service. You must be at least 13 years old to use Lostly. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.

3. What Lostly Does — and Does Not — Do

Lostly provides a technology platform that:

Lostly is not a storage service, courier, insurance provider, or guarantor of any kind. We do not take physical possession of any items at any time. We are a platform connecting users — we are not a party to any transaction or arrangement between users.

4. No Guarantee of Recovery

We do not guarantee that a lost item will be found, matched, claimed, or returned. Matches are generated automatically and may be inaccurate. The quality or outcome of any match depends entirely on information provided by users. The decision to engage with any match is entirely yours.

5. Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

(a) Lostly is not liable for the loss, theft, damage, or destruction of any item — whether reported on the platform or not.

(b) Lostly is not liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of the service, including but not limited to: loss of property, financial loss, emotional distress, or costs incurred in connection with a lost or found item.

(c) Lostly is not responsible for the conduct of other users. We do not verify the identity, credentials, or intentions of users, and we are not liable for any harm caused by another user's actions or omissions.

(d) Use of Lostly is entirely at your own risk.

(e) Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim, or EUR 50, whichever is greater.

7. Consumer Rights — EU and UK Users

Nothing in these Terms limits or excludes any rights you have under mandatory consumer protection laws in your country of residence that cannot be waived by contract. If you are a consumer in the European Union or United Kingdom, you may have additional rights under local law, including rights under the EU Consumer Rights Directive or the UK Consumer Rights Act 2015. These Terms do not affect those statutory rights.

EU consumers have the right to withdraw from a service contract within 14 days of purchase. However, by requesting immediate access to a digital service you acknowledge that this right is lost once the service has been fully performed.

We reserve the right to suspend or terminate accounts that violate these Terms, without notice and without liability.

9. Shipping and Payments

If you choose to use our optional shipping coordination service, a platform fee applies per shipment. Shipping costs are passed through at carrier rates. Payment is processed securely via Stripe. All fees are clearly displayed before you confirm a shipment. Fees are non-refundable once a shipping label has been created, except where required by applicable consumer law.

10. Dispute Resolution — US Users

If you are located in the United States, you agree that any dispute arising from these Terms or your use of Lostly shall be resolved by binding individual arbitration under the rules of the American Arbitration Association, and not in court. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. This arbitration clause does not apply to claims that qualify for small claims court.

11. Intellectual Property

All content, branding, and technology in Lostly is owned by Nordic Business Advisory ApS or its licensors. You may not copy, reproduce, or distribute any part of the service without our prior written consent.

12. Privacy and Data Protection

We process personal data in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the app or email at least 30 days before they take effect. Continued use of Lostly after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms you may delete your account at any time.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Denmark, without regard to conflict of law principles, except where mandatory local consumer protection laws in your country of residence apply (including EU, UK, and US state laws where applicable). Subject to Section 10 (arbitration for US users), disputes shall be subject to the non-exclusive jurisdiction of the Danish courts, without prejudice to your right to bring proceedings in your country of residence if required by local law.
